Problem with "delete legacy files"

When i use a folder reference in my project and turn on "Delete legacy files" in the advanced project settings, all files in the target directory (from the folder reference) will be delete when patching the software even though the files havn't changed from the latest to the newest version.

This does not happen if i do a full history patch.

Any idea why this happens?

Does this only happen when you use a Folder Reference? What happens if you add the files (without a folder reference)?

Yes, this does only happen if i use a folder reference and skip at least one version when i create a patch. For instance building a patch from version 1.0 to 1.2 skipping version 1.1. If i build a patch without using a folder reference adding each file, this error does not occur.
